§ 1. DEFINITIONS
Working days – days from Monday to Friday, excluding public holidays.
Customer Account – a free function of the Store (a service provided electronically) regulated by separate regulations, thanks to which the Buyer can set up his/her individual Account in the Store.
Consumer – Consumer within the meaning of the provisions of the Civil Code, i.e. a natural person concluding a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.
Entrepreneur – Entrepreneur within the meaning of the provisions of the Civil Code, i.e. a natural person, a legal person and an organizational unit that is not a legal person, to which the law grants legal capacity, conducting business or professional activity on its own behalf.
Entrepreneur with consumer rights – means a natural person concluding a sales contract directly related to his/her business activity, when the content of the sales contract indicates that it is not of a professional nature for this entrepreneur, resulting in particular from the subject of the business activity performed by him/her, made available on the basis of the provisions on the Central Register and Information on Business Activity.
Buyer – means an entity with which, in accordance with the Regulations, a sales contract may be concluded as part of the online store’s operations.
Regulations – means these regulations.

§ 3. TECHNICAL REQUIREMENTS – SERVICES PROVIDED ELECTRONICALLY
1. To use the Store, including browsing the product range and placing orders, you must have:
- A multimedia device with access to the Internet and e-mail,
- A web browser that supports JavaScript and cookies.
2. The Seller enables Buyers to provide free services in the scope of maintaining a Customer Account, newsletter, using the contact form, posting opinions, participating in the loyalty program and using promotional offers, including personalized offers sent via e-mail.
3. The Seller, Buyer and other Users are obliged to use the Store in a manner consistent with the law and good manners; in particular, it is prohibited to provide content that is illegal and contrary to good manners.
§ 4. PURCHASES IN THE STORE – SALES AGREEMENT
1. The information contained on the Store Website does not constitute an offer by the Seller within the meaning of the Civil Code, but is an invitation to Customers to submit offers to conclude a sales contract.
2. The prices of goods displayed in the Store are total prices for the goods, including value added tax (VAT). For purchases with delivery outside of Poland, prices may change depending on the applicable VAT rate in the country of delivery.
3. The Seller points out that the total price of the order consists of the price of the goods indicated in the Store and, if applicable, the costs of delivery of the goods.
4. The goods selected for purchase should be added to the basket in the Store.
5. The Buyer then selects from those available in the Store: the method of delivery of the goods and the method of payment for the order, and provides the data necessary to complete the placed order.
6. The order is placed upon confirmation that the Buyer has read and accepted the Regulations.
7. Placing an order constitutes the Buyer's submission to the Seller of an offer to conclude a sales contract for the items that are the subject of the order and is not tantamount to reserving the stock of the selected products until the order is paid for.
8. Placing an order by the Buyer does not constitute the conclusion of a sales contract. The contract is concluded only after the Seller has positively verified the order, including, in particular, verifying the accuracy of the data, product availability, and the absence of obvious errors, including pricing errors. The sales contract is concluded when the Seller sends the Buyer a separate email informing them that the order has been accepted for processing. If a gross error in the product price or other obvious system error is detected, the Seller reserves the right to cancel the order. The Buyer will be immediately informed of this situation, and the payment will be refunded in full.
9. The Seller makes every effort to ensure that all information provided in the Store, in particular prices and product descriptions, is factually accurate and up-to-date. In the event of an obvious and gross error, including, in particular, a pricing error consisting in a price reduction significantly different from the typical market value, the Seller reserves the right to cancel any order placed based on such incorrect information. An obvious error is considered to be, in particular, a situation in which the difference between the indicated price and the typical market price is at least 50%, or when the price is clearly unrealistic given the characteristics and value of the product. In the event of an order cancellation for the reasons specified above, the Buyer will receive appropriate information and a refund of all payments made.
10. The Seller will provide the Buyer with confirmation of the conclusion of the sales contract no later than upon delivery of the goods.
11. The Buyer may register in the Store, i.e. create a Customer Account, or make purchases without registration by providing his/her data with each order.
12. For one Buyer - customer of the online store within a given price promotion and a given outlet offer, the purchase limit is 30 (in words: thirty) pieces of a single product.
13. If payment for the order is not received within 7 days of its placement, the Seller has the right to cancel the order. Payment is deemed made when the funds are credited to the Seller's bank account or sub-account operated by the PayU payment provider. After the deadline has passed without payment, the order will be canceled without further notice to the Buyer.
14. The content and graphics posted on the website are the legally protected property of UNIPRO Sp. z o. o. and may not be used in any way by other persons without its consent.
§ 5. PAYMENTS
1. The order can be paid for, depending on the Buyer's choice:
- Via the PayU payment platform, immediately after placing the order, or
- Via a classic bank transfer to the account:

In the transfer title, please enter the order number received in the confirmation email.
2. The Seller does not offer the option of cash on delivery.
3. Unpaid orders will not be processed.
4. The Seller informs that in the case of some payment methods, due to their specific nature, payment for the order using this method is only possible immediately after placing the order.
§ 6. ORDER FULFILLMENT
1. The order completion date is indicated in the Store.
2. The Seller offers shipping within the Republic of Poland and to selected European Union countries, in accordance with the information provided in the order form. If delivery to a given country is not possible, the Seller will inform the Buyer immediately after placing the order, and the payment will be refunded in full.
3. The available order shipping methods within the Republic of Poland are:
- GLS Automat / Point
- InPost parcel lockers
- InPost courier
- ORLEN Package
- Pocztex
- Pocztex Courier
- GLS courier
- Poltraf – shipping under controlled conditions (recommended when ordering products from the medical device category).
For international orders the shipping method offered is:
- GLS courier
4. In the event of the return of a parcel containing the purchased goods to the Seller as a result of the Buyer failing to collect the parcel for reasons attributable to the Buyer, the Seller shall refund the value of the order to the Buyer less the shipping costs according to the Online Store's shipping price list, due to the shipping costs incurred.
§ 7. RIGHT OF WITHDRAWAL FROM THE CONTRACT
1. Buyers who are Consumers and Entrepreneurs with consumer rights have the right to withdraw from the contract concluded with the Seller via the Store, subject to § 8 of the Regulations, within 14 days without giving any reason.
2. The deadline for withdrawal from the contract expires after 14 days from the date of:
- In which the Consumer or an Entrepreneur with consumer rights came into possession of the goods or in which a third party other than the carrier and indicated by the above persons came into possession of the goods.
- On which the Consumer or an Entrepreneur with consumer rights came into possession of the last item or on which a third party, other than the carrier and indicated by the above persons, came into possession of the last item in the case of a contract obliging the transfer of ownership of multiple items that are delivered separately.
3. In order for the Consumer or Entrepreneur with consumer rights to exercise the right to withdraw from the contract, he or she must inform the Seller, using the data provided in § 2 of the Regulations, of his or her decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post or information sent by e-mail).
4. The Consumer or Entrepreneur with consumer rights may use the model withdrawal form provided at the end of the Regulations, but this is not obligatory.
5. In order to meet the withdrawal period, it is sufficient for the Consumer or Entrepreneur with consumer rights to send information concerning the exercise of his right to withdraw from the contract before the expiry of the withdrawal period.
EFFECTS OF WITHDRAWAL FROM THE CONTRACT:
6. In the event of withdrawal from the concluded contract, the Seller shall refund all payments received from the Buyer who is a Consumer or an Entrepreneur with consumer rights, withdrawing from the contract in accordance with § 7 of the Regulations, immediately, and in any case no later than 14 days from the date on which the Seller was informed of the Buyer's decision to exercise the right of withdrawal. The refund also includes the cost of delivery of the goods, except where the order has already been dispatched before the declaration of withdrawal is submitted. The Seller may withhold reimbursement until the Buyer receives the returned goods or provides proof of sending them back, whichever occurs first.
7. The Seller will refund the payment using the same payment methods that were used by the Buyer in the original transaction, unless the Buyer agrees to a different solution; in any case, the Buyer will not incur any fees in connection with this refund.
8. The Seller may withhold reimbursement until receipt of the goods or until proof of their return is provided, whichever occurs first.
9. The Seller requests that the goods be returned to the following address: Targowisko 553, 32-015 Kłaj immediately, and in any event no later than 14 days from the date on which the Buyer informed the Seller of their withdrawal from the sales contract. The deadline is met if the Buyer sends the goods back before the expiry of the 14-day period.
10. The buyer bears the direct costs of returning the goods.
11. The Seller will not accept returns of goods that show signs of wear or have been opened. In such a situation, the Seller reserves the right to refuse a refund, and the Buyer must collect the defective or used goods at their own expense.
§ 8. EXCEPTIONS FROM THE RIGHT OF WITHDRAWAL FROM THE CONTRACT
1. The right to withdraw from a distance contract does not apply to the Consumer or the Entrepreneur with consumer rights in relation to the contract:
- Where the subject of the provision is a non-prefabricated item, manufactured according to the Consumer’s specifications or intended to meet his individual needs.
- Where the subject of the service is an item that spoils quickly or has a short shelf life.
- Where the subject of the service is an item delivered in a sealed package which cannot be returned after opening the package for health protection or hygiene reasons if the package was opened after delivery.
- Where the subject of the performance are things which, after delivery, due to their nature, are inseparably connected with other things.
- Where the subject of the provision are sound or visual recordings or computer programs delivered in a sealed package, if the package has been opened after delivery.
- For the supply of newspapers, periodicals or magazines, with the exception of subscription agreements.
- Where the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline for withdrawal from the contract expires.
- For the supply of digital content that is not recorded on a tangible medium, if the performance of the service has begun with the express consent of the Consumer before the expiry of the withdrawal period and after the entrepreneur has informed the Consumer of the loss of the right to withdraw from the contract.
2. The right to withdraw from a distance contract does not apply to any entity other than the Consumer or an Entrepreneur with consumer rights.
§ 9. COMPLAINTS
1. The Seller guarantees the delivery of goods free from physical and legal defects. The Seller is liable to Buyers for defects in the goods sold (warranty for defects) to the extent specified in Article 556 et seq. of the Civil Code, and for non-conformity of the goods with the contract within the meaning of the Consumer Rights Act.
2. In the event of a defect in the goods, complaints may be submitted in any form, with the preferred method of submitting complaints:

- in writing to the following address: Sklep Activlab, Targowisko 553, 32-015 Kłaj.
3. The complaint should include: the order number, a description of the problem (with photo documentation), contact details of the person filing the complaint and the preferred method of resolving the matter if the complaint is deemed justified.
4. The Seller is responsible for the safe delivery of the goods until the shipment containing the purchased goods is delivered. In order to file a complaint regarding defects and visible damage to the shipment during transport, it is necessary to inspect its contents in the presence of the courier and complete a damage report and take photos:
- damaged outer packaging of the parcel,
- view of products in the package (showing how the goods are secured),
- Products damaged during transport. The above photos should be sent to the following email address: ebok@activlab.pl .
5. When making use of the warranty, the Buyer may, under the terms and within the time limits specified in the Civil Code:
- Submit a declaration of price reduction or withdrawal from the contract,
- Demand the replacement of the item with a defect-free one or the removal of the defect.
6. Before the Buyer requests a price reduction or withdrawal from the contract, the Seller will immediately and conveniently replace the goods with defect-free ones or remove the defect. However, if the non-conformity persists or the Seller is unable to remove the defect within a reasonable time and in a manner convenient for the Buyer, the Buyer may request a price reduction or withdrawal from the contract.
7. In the event of a significant lack of conformity of the goods with the contract, an immediate price reduction or withdrawal from the contract requested by the Buyer is justified.
8. If it turns out that the complaint must be resolved by delivering the goods to the Seller, the Buyer is obligated to deliver the goods (in the case of a Consumer or an Entrepreneur with Consumer rights) at the Seller's expense to the following address: Targowisko 553, 32-015 Kłaj. Prior contact with the Seller is required to arrange shipping details. In the case of a Customer who is a Consumer, the Seller covers the shipping costs.
9. If an additional warranty has been granted for the goods, information about it and its terms is available in the product description in the Store and is attached to the goods.
10. The Seller will review the complaint within 14 days of receiving the complaint along with the product in question. The Seller reserves the right to withhold review of the complaint until the product in question is delivered, if this is necessary to assess the validity of the complaint.
11. Unipro Sp. z o. o. is responsible for all complaints and returns of goods for orders placed on the online store website in accordance with the terms of this paragraph 9.
OUT-OF-COURT METHODS OF SETTLING COMPLAINTS AND SEEKING CLAIMS:
1. If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:
- Mediation is conducted by the relevant Provincial Trade Inspectorate, to which a request for mediation should be submitted. As a rule, the proceedings are free of charge. A list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
- Assistance from the locally competent permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, to which an application for consideration of the case before the arbitration court should be submitted. As a rule, the proceedings are free of charge. A list of courts is available at: https://www.uokik.gov.pl/wazne_adresy.php#faq596.
- Free assistance from the municipal or district consumer ombudsman.
- The ODR online platform is available at: http://ec.europa.eu/consumers/odr/.
§ 10. PERSONAL DATA
1. The Seller is the administrator of personal data provided by the Buyer when using the Store.
2. The Buyer's personal data is processed on the basis of the contract and for the purpose of its implementation, in accordance with the principles set out in the General Data Protection Regulation of the European Parliament and of the Council (EU). Detailed information regarding data processing by the Seller is included in the privacy policy posted in the Store.
3. When placing an order, the Buyer is obliged to consent to the processing of personal data by the courier company and the PayU payment operator (if this payment method is chosen) to the extent necessary to complete the order.
§ 11. DISCLAIMERS
1. The Buyer is prohibited from providing illegal content.
2. Each order placed in the Store constitutes a separate sales agreement and requires separate acceptance of the Terms and Conditions. The agreement is concluded for the time and purpose of fulfilling the order.
3. Agreements concluded on the basis of these regulations are concluded in Polish.
4. In the event of a dispute with a Buyer who is not a Consumer, the competent court will be the court having jurisdiction over the registered office of the Seller.
5. None of the provisions of these regulations exclude or in any way limit the Consumer's rights arising from legal provisions.
6. The law of the Republic of Poland shall apply to contracts concluded between the Buyer and the Seller.
7. Notwithstanding the provisions of point 6 of this paragraph, the mandatory provisions of the country of origin of the Buyer who is a consumer will be complied with.
8. Selecting a delivery country other than Poland within the EU will change the displayed product price, taking into account the VAT rate applicable in the shipping country.

§ 3 TECHNICAL REQUIREMENTS
- For the proper functioning and creation of an Account, you need:
- Active email account
- A device with internet access
- A web browser that supports JavaScript and cookies
§ 4 ACCOUNT
- Creating an Account is entirely voluntary and depends on the will of the Buyer.
- The account gives the Buyer additional options, such as: viewing the history of orders placed by the Buyer in the Store, checking the status of the order or editing the Buyer's data independently.
- To create an Account, please complete the appropriate form in the Store.
- When an Account is created, an agreement is concluded for an indefinite period between the Buyer and the Seller regarding the management of the Account on the terms specified in the Regulations.
- The Buyer may cancel the Account at any time without incurring any costs.
- In order to cancel your Account, you must send your cancellation to the Seller at the following e-mail address: ebok@activlab.pl, which will result in immediate deletion of the Account and termination of the Account management agreement.
§ 5 COMPLAINTS
- Complaints regarding the functioning of the Account should be sent to the e-mail address ebok@activlab.pl.
- The complaint will be considered by the Seller within 14 days.
OUT-OF-COURT METHODS OF SETTLING COMPLAINTS AND SEEKING CLAIMS - If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:

§ 6 PERSONAL DATA
- The administrator of personal data provided by the Buyer when using the Store is the Seller.
- The Buyer's personal data is processed on the basis of a contract and for the purpose of its implementation, in accordance with the principles set out in the General Data Protection Regulation of the European Parliament and of the Council (EU). Detailed information regarding data processing by the Seller is included in the privacy policy posted in the Store.
§ 7 DISCLAIMERS
- The Buyer is prohibited from providing illegal content.
- The Account management agreement is concluded in Polish.
- In the event of important reasons referred to in paragraph 4, the Seller has the right to change these Account regulations.
- The important reasons referred to in paragraph 3 are:
- the need to adapt the Store to the legal provisions applicable to the Store's activities
- improving the security of the service provided
- a change in the functionality of the Account requiring a modification of the Account regulations.
- The Buyer will be informed about the planned change to the Account regulations at least 7 days before the change comes into effect via an e-mail sent to the address assigned to the Account.
- If the Buyer does not accept the planned change, he/she should inform the Seller about it by sending an appropriate message to the Seller's e-mail address ebok@activlab.pl, which will result in termination of the Account management agreement upon entry into force of the planned change or earlier if the Buyer submits such a request.
- If the Buyer does not object to the planned change until it comes into effect, it is assumed that he accepts it, which does not constitute any obstacle to terminating the contract in the future.
- In the event of a dispute with a Buyer who is not a Consumer, the competent court will be the court having jurisdiction over the registered office of the Seller.
- None of the provisions of these regulations exclude or in any way limit the rights of the Consumer arising from legal provisions.
Activlab store newsletter regulations
§ 1 DEFINITIONS
Newsletter – a free-of-charge service provided electronically, thanks to which the Service Recipient can receive previously ordered messages regarding the Store from the Service Provider electronically, including information about offers, promotions and new products in the Store.

Service Provider - UNIPRO Sp. z o. o. with its registered office at Targowisko 553, 32-015 Kłaj, entered into the National Court Register under number 0000338841, NIP No. 6762407022, REGON No. 121036760, share capital PLN 245,000.00.
Service recipient - any entity using the Newsletter service.
§ 2 Newsletter
- The Service Recipient may voluntarily use the Newsletter service.
- To use the Newsletter service, you must have a device with the latest version of a web browser that supports JavaScript and cookies, access to the Internet, and an active e-mail account.
- E-mails sent as part of this service will be sent to the e-mail address provided by the Service User when subscribing to the Newsletter.
- To conclude a contract and subscribe to the Newsletter service, the Service User first provides their email address in the designated area on the Website to which they wish to receive Newsletter messages. The Service Provider will then send the Service User an email address verification to the email address provided in the first step, which will include a link to confirm the Service User's intention to subscribe to the Newsletter. Once the Service User confirms their intention to subscribe to the Newsletter, a service contract is concluded, and the Service Provider will begin providing the service to the Service User.
- The messages sent as part of the Newsletter will contain information about the possibility of unsubscribing from it, as well as a link to unsubscribe.
- The Service Recipient may unsubscribe from the Newsletter, without giving any reason and incurring any costs, at any time, using the option referred to in paragraph 5 or by sending a message to the e-mail address of the Service Provider: ebok@activlab.pl .
- The Service User's use of the link to unsubscribe from the Newsletter or sending a message requesting unsubscription from the Newsletter will result in immediate termination of the contract for the provision of this service.
§ 3 Complaints
- Complaints regarding the Newsletter should be reported to the Service Provider at the following e-mail address: ebok@activlab.pl .
- The Service Provider will respond to the complaint within 14 days of receiving the complaint.
§ 4 Personal data
- The administrator of personal data provided by the Service User when using the Newsletter is the Service Provider.
- The Service Recipient's personal data is processed on the basis of a contract and for the purpose of its implementation, in accordance with the principles set out in the General Data Protection Regulation of the European Parliament and of the Council (EU). Detailed information regarding data processing by the Seller is included in the privacy policy posted in the Store.
§ 5 Final provisions
- The Service Provider reserves the right to amend these Terms and Conditions only for important reasons. An important reason is understood to mean the need to amend these Terms and Conditions due to the modernization of the Newsletter service or changes in legal regulations that affect the provision of the service by the Service Provider.
- Information about planned changes to the regulations will be sent to the e-mail address of the Service User provided when subscribing to the Newsletter at least 7 days before the changes come into effect.
- If the Service Recipient does not object to the planned changes until they enter into force, it is assumed that he or she accepts them.
- In the event of non-acceptance of the planned changes, the Service User should send information about this to the Service Provider's e-mail address: ebok@activlab.pl , which will result in termination of the service provision agreement upon entry into force of the planned changes.
- The Service User is prohibited from providing illegal content.
